  • Altering the assessment without any authority (except to correct any bona fide error).
  • Willful violation of norms or standards of a public examination on its own or through its agency.
  • Tampering any document that is necessary for short-listing candidates or finalizing the merit or rank of a candidate in a public examination.

Punishment For “Unfair Means” Mentioned In The Bill

According to the draft bill, all the offenses will be cognizable, non-bailable, and non-compoundable. The bill will be merged later with the Bharatiya Nyaya Sanhita, 2023 brought into force in the system. Until that the sections of the Indian Penal Code, 1860 will be applicable to file the cases against the criminals. Here are the punishments for the mentioned offenses as mentioned below.

  • If any individuals are found guilty as per the definition under the “unfair means and offenses” of the bill, they can face imprisonment for a term of 3 – 5 years. They have to pay a fine of up to Rs 10 lakh. Additional imprisonment can be imposed for defaulting the fine payment as per the Bharatiya Nyaya Sanhita, 2023 in the future.
  • The service providers can be fined up to Rs 1 crore. These fines will also include the recovery of examination costs. These service providers will be blacklisted and they will not be able to conduct any public examinations for the next four years.
  • If the directors or any senior management are found guilty, they will face imprisonment for 3 – 10 years. With this, they have to pay a fine of Rs 1 crore. Additional imprisonment can be imposed for defaulting the fine payment as per the Bharatiya Nyaya Sanhita, 2023 in the future.
  • As per the Bharatiya Nyaya Sanhita, 2023, these are the organized crimes. These crimes may result in a minimum imprisonment of 5 years, which can be extended to 10 years, along with a minimum fine of Rs 1 crore for any individuals or examination service providers.

High level National Technical Committee on Public Examinations
